These Terms of Service ("Terms") govern your access to and use of Rally, operated by Fynko Technologies Ltd ("Fynko", "we", "us", or "our").
By creating an account, accessing, or using Rally, you agree to these Terms. If you do not agree to these Terms, do not use Rally.
Rally is a software platform that helps organizations manage activities such as:
The features available to you may depend on your organization, role, subscription, device, permissions, and configuration.
You may use Rally only if you are legally capable of entering into an agreement under applicable law.
If you are using Rally on behalf of an organization, you represent that you are authorized to do so.
Organizations are responsible for ensuring that their use of Rally complies with applicable laws and their obligations to their members.
You are responsible for:
You must notify us if you believe your account has been compromised.
We may take reasonable steps to protect your account or the Service if we reasonably believe an account has been compromised or is being misused.
Rally allows organizations to create and manage organizational structures. Organizations may configure:
Organization administrators are responsible for managing their organization appropriately and for ensuring that information entered into Rally is handled in accordance with applicable law.
Organization administrators and team leaders may have access to information about members according to their assigned permissions. They must use that access only for legitimate organizational purposes.
Organizations are responsible for determining appropriate internal policies regarding:
Fynko provides the platform but does not assume responsibility for every decision made by an organization or its administrators.
An organization may establish additional guidelines for its members. Those guidelines may address matters such as:
Organization guidelines do not replace these Terms or Fynko's Privacy Policy.
Where an organization guideline conflicts with applicable law or these Terms, the applicable law and these Terms take precedence to the extent of the conflict.
Rally provides tools for recording and managing attendance. Attendance records may be created through different methods depending on the features enabled by an organization.
Rally does not guarantee that every attendance record is accurate where information is entered incorrectly, devices malfunction, network connectivity fails, or other circumstances affect the recording process.
Organizations are responsible for establishing their own attendance rules and reviewing attendance records where necessary.
Some Rally features use device location and geofencing.
If you enable applicable location permissions, Rally may use operating-system location capabilities to support attendance and location-based reminders.
You are responsible for deciding whether to grant location permissions. Disabling location permissions may prevent certain features from working.
Location features should not be treated as a guarantee of physical presence or as a substitute for an organization's own attendance procedures where those procedures require additional verification.
Organizations may use Rally's points and achievement features to recognize participation or activity.
Points and achievements may be awarded, changed, or removed according to an organization's rules and authorized administrative actions.
Fynko does not guarantee that points, rankings, achievements, or recognition will have any monetary or other real-world value.
Organizations may use Rally to send announcements and other communications to members. You agree that authorized communications relating to your organization may be delivered through Rally.
You may also receive service-related communications from Fynko where necessary to operate, secure, or administer Rally.
You agree not to use Rally to:
We may investigate suspected violations and take appropriate action.
You may provide information, messages, profile information, images, or other content through Rally. You remain responsible for content you submit.
You represent that you have the necessary rights and permissions to submit that content.
You grant Fynko the limited rights necessary to host, process, display, transmit, and otherwise use your content solely to provide and operate the Service.
We do not obtain ownership of your content merely because you use Rally.
Organizations may submit and manage information through Rally. The organization remains responsible for the accuracy, legality, and appropriateness of information it provides.
Organizations must not use Rally to collect, disclose, or process information unlawfully.
Our collection and use of personal information is governed by the Rally Privacy Policy. The Privacy Policy explains:
Certain Rally features may require an organization subscription or payment. Where payment functionality is available:
Specific billing, renewal, cancellation, or refund terms presented at the time of purchase may also apply.
We will not intentionally impose charges that were not disclosed through the applicable purchasing process.
Rally depends on third-party services and infrastructure. These may include providers supporting:
Third-party services may have their own terms and policies. We are not responsible for independent services that are outside our control.
Rally and its software, design, branding, interfaces, features, documentation, and other materials provided by Fynko are owned by or licensed to Fynko and are protected by applicable intellectual-property laws.
Subject to these Terms, Fynko grants you a limited, non-exclusive, non-transferable right to use Rally for its intended purpose.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Rally except where applicable law expressly permits you to do so.
Nothing in these Terms transfers ownership of Fynko's intellectual property to you.
If you provide suggestions, ideas, recommendations, or other feedback about Rally, you allow Fynko to use that feedback to improve the Service without owing you compensation for doing so.
We aim to keep Rally available and reliable, but we do not guarantee uninterrupted availability. Rally may occasionally be unavailable because of:
We may modify, suspend, or discontinue features where reasonably necessary. Where practical, we will provide notice of material changes.
Some Rally features require:
You are responsible for your device, internet connection, and applicable network charges.
You may stop using Rally at any time.
We may suspend or terminate access where reasonably necessary if:
Where appropriate and reasonably practicable, we will provide notice and an opportunity to address a violation before termination, except where immediate action is necessary for security, legal, fraud-prevention, or other legitimate reasons.
Termination does not automatically eliminate obligations or rights that by their nature should survive termination.
You may request deletion of your Rally account. Account deletion is subject to the processes described in our Privacy Policy.
Certain historical records may remain where legally or operationally necessary.
Deletion of your Rally account does not necessarily delete records maintained independently by an organization or third-party provider.
Rally is provided as a software service and should be used according to its intended purpose.
To the extent permitted by applicable law, we do not guarantee that:
Nothing in these Terms excludes or limits any consumer protection, statutory, or other legal right that cannot lawfully be excluded or limited.
To the extent permitted by applicable law, Fynko will not be responsible for indirect or consequential losses arising from your use of Rally where such limitation is legally permitted.
Nothing in these Terms limits or excludes liability where doing so would be unlawful, including liability that cannot legally be excluded or limited.
We do not seek through these Terms to remove rights or protections that applicable Nigerian consumer or other laws give you.
Where permitted by applicable law, you agree to be responsible for losses or claims arising directly from:
This provision does not require you to indemnify Fynko for losses caused by Fynko's own unlawful conduct, negligence, fraud, or obligations that cannot lawfully be transferred to you.
We may modify Rally from time to time to:
If a material change substantially affects your rights or obligations, we may provide appropriate notice.
We may update these Terms when Rally, our business, applicable law, or our practices change.
For material changes, we may provide notice through Rally, email, or another appropriate method.
Where Rally's document-consent system requires acknowledgment of a new version, users may be asked to accept the updated Terms before continuing to use affected features.
The version and effective date at the beginning of these Terms identify the applicable version.
These Terms are governed by the laws of the Federal Republic of Nigeria, subject to applicable mandatory consumer-protection and other legal rights.
Nothing in these Terms prevents a consumer from exercising rights or pursuing remedies that cannot lawfully be restricted by contract.
If you have a dispute with Fynko, we encourage you to contact us first so that we can attempt to resolve the matter informally.

Nothing in this section prevents you from exercising rights available to you under applicable law or from approaching a competent regulatory authority or court.
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
These Terms, together with the Rally Privacy Policy and any applicable organization-specific terms or guidelines, constitute the agreement governing your use of Rally, except where additional terms expressly apply to a particular feature or transaction.
A failure by Fynko to enforce a provision of these Terms does not mean that Fynko has permanently waived its right to enforce that provision later.
